1. Who is responsible

PadelCue Technologies Inc., corporation number 18007641, provides the PadelCue website, the PadelCue app for iPhone and Android, and the services made available through them. Our registered office is 4711 Yonge Street, 10th Floor, Toronto, Ontario M2N 6K8, Canada. For privacy requests, recording concerns, account deletion and other customer questions, contact support@padelcue.com. For important formal matters requiring our Privacy Officer, contact Mr. Niaki at mo@padelcue.com, or write to the Privacy Officer at our registered office. Business enquiries go to Emma, Mr. Niaki’s assistant, at emma@padelcue.com.

This policy covers website visitors, people contacting us, account holders, participants whose match information we handle, and ambassadors. A feature described here applies when offered and used. This policy does not turn on a feature or obtain another participant's permission. Our services are for adults 18 and older and are not currently offered to residents of Quebec.

We are responsible for information under our control, including processing by providers acting for us. A venue, coach, booking platform or other organization may separately determine its own purposes. The applicable recording or service notice explains the parties and their roles. We do not disclaim our own responsibility simply because a venue or supplier is involved.

The Regional Terms and Privacy Rights give additional information for relevant countries. Mandatory local requirements apply wherever information is actually processed within their scope, regardless of the website language or a person's account label.

2. Information we handle

We use your approximate country, from your IP address, only to show prices in your currency. We do not store it.

Category Examples and sources Main purposes
Contact and application information Name, email, telephone, location, club, role and messages you supply Answer enquiries, arrange requested contact, assess ambassador applications and administer relationships
Account and access information Account identifier, authentication records, eligibility information, preferences and consent records Provide access, respect choices, secure the account and establish the applicable terms

Recordings and player images Video, clips, photographs, snapshots and tracking information from an authorized camera or upload Provide replay, player association, analysis and authorized sharing
Coach clips Video a coach sends to one player, the coach's note and the comments between them Coaching between that coach and that player
Analysis and corrections Estimated events, shots, movement, scores, player associations, derived labels and correction requests Generate reports, investigate errors and provide coaching suggestions
Purchase information Plan, price, currency, transaction references, payment status, renewals, refunds and billing records Supply purchases, process authorized billing and resolve disputes

Optional development material Specifically permitted recordings, images, corrections, labels and derived information Research, test, evaluate, train and improve the sports technology and products identified in the permission

We obtain information from you, your use of the service, authorized participants or venues, and relevant suppliers. We may need to give a person notice even where another participant supplied their information. Being named on a roster does not by itself authorize every use.

Payment providers handle card or financial credentials through the relevant payment flow. Operational records generally need payment references and status rather than a copy of your full card details. Do not submit unnecessary health, identity or financial documents through a general enquiry form.

3. Why processing is permitted

We identify the purposes before or at collection and use the legal basis applicable to the activity and location. These may include supplying a requested service or contract, valid consent, a legal obligation, and a permitted legitimate interest such as proportionate security or fraud prevention. The regional notice explains the relevant framework where a formal legal basis is required.

We do not treat contract necessity as a basis for every commercially useful use of data. Optional identifiable model training and marketing are separate from generating the report you requested. A legitimate interest requires an assessment of necessity, impact and applicable objections. The phrase does not authorize unexpected sensitive processing.

We collect and disclose information reasonably appropriate to the stated purpose. A compatible operational use, such as fixing a playback failure or investigating fraud, differs from a new development or publicity purpose. A materially new use requires the notice, assessment and permission that apply to it before it begins. Prior privacy promises and already granted choices remain relevant to information previously collected.

4. Recording and player association

The recording notice identifies the capture actually enabled, the participants, intended recipients and relevant storage or access periods. Recordings may include identifiable people who do not have an account. Sensitive identification requires its own notice and permission. We require the permissions needed for every affected participant. The payer's choice does not substitute for those choices.

When you agree to match recording, automated software measures how each player moves, for example the position of a wrist or shoulder when a shot is played. These body measurements can be sensitive information, so we take them only with your express agreement in the recording permission. We use them to recognize shots and to follow each player through a match. We do not use player images or body measurements to identify who someone is. Under our contract, our camera provider processes match video to provide its service to us, and may use match data for its own products only in combined form that cannot identify anyone. You can ask us to delete your recordings, or to blur you in another player's copy. Any other use of these measurements by us would need its own notice and permission first.

Academy access does not require court recording, public sharing or promotional permission. A venue notice supplements the participant process. It is not a release for every use of someone's likeness.

Contact us or the venue promptly about an objection, wrong player association or unexpected recording. We assess the request in light of everyone's rights and may stop or restrict processing, correct associations, redact a copy or remove material. A shared match does not give one participant unlimited control over everyone else's information.

5. Automated analysis and human access

Smart Match and Smart Correction Engine features use automated analysis to estimate events, patterns and performance and suggest practice. Results can be incomplete, uncertain or wrong, particularly where footage or player association is poor. They are coaching aids, not official line rulings, medical conclusions or determinations of legal or financial eligibility.

You can ask us to investigate a material error or correct an incorrect association. Authorized personnel and service providers may inspect the information necessary for support, security or a requested review. That limited operational access is not permission to publish the material or enroll it in general training.

If we introduce a use involving a legally significant automated decision or additional sensitive profiling, we must provide the applicable notice, legal basis, safeguards and rights before that use. Calling a function coaching does not exempt its actual processing from a privacy law.

6. Research, training and new products

We use identifiable recordings for software development only with your separate permission. The permission explains which recordings are covered, who receives them, how long they are kept and how to withdraw. Saying no never affects recording, your plan or your Academy access. You can withdraw at any time by emailing support@padelcue.com.

We may commercially use the resulting technology and lawful statistical findings. Unless a separate agreement promises compensation, participation does not create an entitlement to royalties, equity or ownership of a resulting product. This does not override rights in personal information, underlying content or independently agreed remuneration.

A person contributing material must have the rights they grant, and all affected people's necessary permissions must be covered. We do not infer a training permission from a correction, an upload, a paid match, publicly accessible footage or a generic acceptance of terms. A new unrelated or incompatible use requires a new appropriate process.

7. Anonymized information and ownership

Where legally permitted, we may produce genuinely anonymized information and use it for research, development, benchmarking, statistical reporting, business analysis and commercial products or licences. Anonymization itself must be lawful and appropriately assessed. We do not assume identifiable raw footage becomes anonymous because we remove an account name, blur a face or assign an internal identifier.

We assess reasonable identification risk in context, including linkage with other information. Information that still identifies a person or can reasonably be linked to one remains subject to applicable law and this policy. Recipients of anonymized datasets must not attempt prohibited reidentification or use them to circumvent privacy rights.

PadelCue may own rights in its lawfully created software, models, annotations and methods, subject to other parties' underlying rights and any agreement. Ownership of technology is not ownership of a person's privacy rights. A model or output that contains personal information remains subject to the obligations applicable to that information.

8. Recipients and access boundaries

We may disclose information to the following recipients for the relevant permitted purposes:

We use service providers for website hosting, email delivery, business email, app hosting, payments, app store billing, and camera and video processing. For example, Vercel Inc. hosts our website, Resend delivers email from our website contact form and Google Workspace provides our business email. Our contracts with them limit how they may use your information. Payment providers and app stores also handle some information for their own fraud, security and legal purposes under their own privacy policies. Where the law gives you the right, we will tell you more about the providers that handle your information.

Vercel Inc. also acts as our service provider for website statistics through Vercel Web Analytics, with reports kept for up to 12 months.

We do not currently sell personal information or share it for advertising across unrelated services. Commercializing genuinely anonymous information or a lawfully developed product is different from selling a person's footage or profile. Any future activity that legally constitutes a sale, targeted advertising or comparable sharing requires an updated disclosure, the applicable consent or opt out mechanisms and respect for prior commitments before it is enabled. We do not sell or profit from protected biometric identifiers where prohibited.

9. International processing

Our providers process information outside Canada in the United States (website hosting, email, business email, payments, app store billing, and storage and delivery of match video, coach clips, player uploads and Academy video) and in the European Union (camera and video processing of match video, and app development and support in Denmark). Our delivery network may keep temporary copies of videos near viewers in other countries. Our copies of match video are stored in the United States, in our cloud storage provider's US East region. For written information about our policies and practices for providers outside Canada, including the countries and purposes involved, email support@padelcue.com or write to the Privacy Officer at our registered office. Use the same routes for questions about how these providers collect, use, disclose or store your information.

Information processed or stored outside Canada, for example in the United States, can be accessed by the courts, law enforcement and national security authorities of that country under its laws. Where applicable, we use an available adequacy mechanism, contractual safeguards and necessary supplementary measures, or another lawful transfer route. Canadian accountability continues for processing on our behalf. EEA or UK transfers, for example, are assessed under their own transfer rules rather than an assumed worldwide permission.

Contact support@padelcue.com for information about the safeguards applicable to your data and, where you have the right, a copy of the relevant safeguards subject to justified redactions. A worldwide content licence does not replace a data transfer requirement.

10. Retention and deletion

We retain information for the specified purposes and justified legal, accounting, dispute or security needs. We take account of sensitivity, the service period, an applicable permission, required records and whether a less identifiable record will suffice. We do not retain every category indefinitely simply because storage is possible.

Record Applicable rule
Website enquiries and ambassador applications Until your enquiry is resolved, then normally up to 24 months after our last contact, or sooner if you ask us to delete it
Marketing consent and unsubscribe records While you receive our marketing, then 3 years, so we can show we had permission. We keep the minimum needed to respect an unsubscribe for as long as it applies
Email delivery records Normally up to 12 months
Account, lesson and support records While needed for the active service or request, then deletion or lawful anonymization unless another specific legal purpose requires retention
Raw recordings, clips and snapshots of a match Up to 12 months after the match, then we delete our copies, including the raw video and backups, and ask our camera provider to delete its copy. Viewing a recording needs an active plan or the match purchase. If you cancel, you keep access until the end of the period you paid for. A match bought separately keeps its own access rules. You can ask us to delete a recording sooner. If you appear in another player's copy, you can ask us to remove or blur you
Coach clips and comments Up to 12 months after sending, or sooner if the coach or player deletes them or someone shown asks us to remove them
Match reports and statistics derived from a recording For as long as your account exists, then deletion or lawful anonymization unless another specific legal purpose requires retention. Viewing a report needs an active plan or the match purchase. If you cancel, you keep access until the end of the period you paid for. A match bought separately keeps its own access rules.
Any sensitive templates The applicable feature notice identifies the period before collection
Optional development material The period in its specific permission or a shorter period required by withdrawal, purpose completion or law. Longer or materially different use requires a valid new basis and process
Payment, tax, referral and claims records For the applicable statutory recordkeeping, reconciliation and limitation periods, with longer retention only for a justified requirement or dispute
Logs, caches and backups For the defined security and recovery cycle. Access is restricted and expired data is removed through the relevant process. A restored backup must not revive a withdrawn use

The periods and criteria for newly introduced services must be given before their collection starts.

You can request deletion or withdraw optional permission through the available service controls or support@padelcue.com. We identify relevant systems and providers, verify identity proportionately, act within applicable deadlines and explain any exception. A pending dispute, financial record or required consent log does not justify unrelated reuse of the underlying footage.

Withdrawal stops future processing based solely on that consent and does not make earlier lawful processing unlawful. The handling of information already irreversibly anonymized or used in a model depends on whether it remains personal information and what law requires. Technical difficulty alone does not extinguish a right, authorize continued identifiable retention or guarantee that a trained model is exempt. We do not promise technically unverified model unlearning.

Copies independently downloaded or republished by other people may be outside our control. We address material under our control and appropriate assistance requests, protect other participants when providing access, and explain a refusal or limitation where required.

11. Marketing, invitations and measurement

We send marketing email only with your agreement, or where Canada's anti spam law and the law where you live otherwise allow it. For example, we may contact a club, federation or other organization, or a professional who publishes a business contact, about PadelCue, where the message relates to their role and they have not said they do not want such messages, using contact details they publish on their website, a federation page or a booking platform. Agreeing to marketing is never a condition of an enquiry, an account, a purchase or a recording. We do not buy or rent marketing lists.

To find partners, we keep a list of padel clubs, federations, coaches and ranked players, including amateur and junior players listed by their federation, made from published sources such as club websites, federation pages, ranking lists and booking platforms. We use it only to find and contact partners about working with PadelCue. We do not message people under 18 or amateur players who have not published a business contact. To be removed, email support@padelcue.com.

Commercial messages identify the sender, contact and mailing information and provide an accessible unsubscribe route. For the Canadian programme, that route remains available for at least 60 days and requests are honoured promptly and no later than 10 business days. Shorter applicable local periods take priority. Necessary transaction or support messages may continue, but adding promotional content does not make it necessary.

Delivery and bounce information support requested communications. Optional open or click measurement, behavioural analytics or advertising requires the notice and choices applicable to that technology and location. Neither a marketing signup nor a service licence grants unlimited invisible tracking.

12. Cookies and your choices

The Cookie Policy lists the website's current storage and clearing controls. The current website code uses display preference storage and does not load advertising pixels, behavioural analytics, session replay or referral tracking cookies. That current description does not mean the site can never introduce lawful new features.

Website statistics use no cookies and count visits by a hash of the request that Vercel discards after 24 hours, with data including page, referrer, country, device type and browser. Statistics run where the law allows and stay off in the European Union, the European Economic Area and Quebec, when Global Privacy Control is enabled or when you turn them off for free through the Cookie Policy.

We may introduce necessary functions, optional measurement, personalization, embedded services or advertising with an accurate current inventory and the required choices before activation. Optional tracking is not authorized merely by browsing or accepting our Terms. Where applicable, we respect recognized universal opt out signals for covered activities and do not circumvent a recorded choice using a different identifier or server connection.

13. Safeguards and incidents

We use safeguards appropriate to the nature and sensitivity of information, including access restrictions, account protection, secure transmission, appropriate storage protections, provider requirements and incident procedures. We minimize access to recordings and privileged administrative functions. No system is immune from security failure, and this statement is not a guarantee of absolute security.

We investigate incidents, take appropriate containment measures, preserve necessary evidence and notify affected people and authorities when required. A supplier must support the response to the extent of its duties. Outsourcing does not eliminate our own obligations. Applicable reporting thresholds and deadlines vary by location.

14. Rights, complaints and children

Depending on the law, you may request access, correction, deletion, restriction, portability, withdrawal of consent, objection to processing, an appeal of a rights decision or an opt out of specified uses. See the regional notice. You can contact support@padelcue.com without paying for an account or a match. We verify identity and authority only as reasonably necessary and respect other people's rights.

For an ordinary Canadian access request, the statutory framework is generally 30 days, with lawful extensions where applicable. Other regions have different periods. We explain an applicable extension, exception or refusal and the available complaint route. We do not impose a fee for ordinary requests. An exceptional fee must be legally permitted and explained. We do not penalize a person for exercising protected rights.

PadelCue accounts are for people 18 and older, and you confirm you are 18 or older when you sign up. We do not knowingly record a match while anyone under 18 is on court, and matches that include anyone under 18 are never used for training. A camera can still capture a child by accident, for example near the court. If we learn that a child gave us information or was recorded, we restrict or delete that information.

You may complain to the competent privacy authority without our permission, including the Office of the Privacy Commissioner of Canada or the authority identified in the regional notice.

15. Changes

We identify the edition above and give appropriate notice of material changes. A new purpose or materially different data practice requires the legal basis, notice and fresh permission that apply to it. We do not treat a silent website update as retrospective authorization to train on, sell or publish material collected under narrower promises.
