1. How this notice applies
This notice supplements PadelCue's Terms and Conditions, Privacy Policy, Cookie Policy and Recording and Development Permissions. It covers the markets below where the relevant law applies. Availability depends on the actual offer, location and supported service. An English website does not make every service available worldwide or replace required local language information.
Mandatory local protections take priority over conflicting general wording. A business account label does not remove protected consumer or small business status. Our consumer Terms do not impose compulsory arbitration, a waiver of class or representative proceedings or an exclusive Toronto court requirement. Any exclusion or limit of our liability in the Terms applies only where the law allows it and never reduces a guarantee, right or remedy that consumer or privacy law gives you. You retain the courts, tribunals and regulator routes available under applicable law.
Your provider and the organization responsible for the processing it determines is PadelCue Technologies Inc., corporation number 18007641, 4711 Yonge Street, 10th Floor, Toronto, Ontario M2N 6K8, Canada. Contact support@padelcue.com about purchases, cancellation and information rights. For important formal matters requiring our Privacy Officer, use the Privacy Policy contact. You may also write to that address. We provide any additionally required local representative or officer details for the relevant service.
2. Requests and choices
You do not need to buy a service or create an account to make a privacy request. Identify the information or activity involved and how we can contact you. We verify identity or authority only as reasonably necessary, protect other people's information and explain any lawful refusal, extension or exceptional fee. Applicable exceptions and response periods depend on the right and jurisdiction. A request to stop advertising is different from deletion of an account, cancellation of a subscription or destruction of required financial records.
Consent may be withdrawn for the purpose for which it was given. Withdrawal does not make completed lawful processing unlawful, but we stop processing based solely on the withdrawn permission as required. Necessary service processing, optional identifiable model development, promotional publication and optional tracking have separate purposes. Neither a club contract nor a payer's acceptance supplies every participant's permission.
3. Canada
Our services are not currently offered to residents of Quebec. Where PIPEDA applies, you may request access to personal information, information about its use and disclosure, and correction, withdraw consent subject to lawful restrictions, and challenge compliance. We normally respond to access requests within 30 days. A lawful extension requires notice and an explanation. Provincial privacy laws may provide additional rights. Complaints may be made to the Office of the Privacy Commissioner of Canada or the competent provincial authority.
Our services are for adults 18 and older. Match recordings, including the raw video, are kept for up to 12 months after the match and then deleted. Some information is processed or stored outside Canada, including match video, which we store in the United States, and camera and video processing of match video in the European Union. Information held outside Canada can be accessed by authorities there under local law. Section 9 of the Privacy Policy explains the purposes. In Alberta and elsewhere in Canada, you can request written information about our policies and practices for service providers outside Canada by emailing support@padelcue.com or writing to the Privacy Officer at our registered office. Our Privacy Officer answers questions about these policies and practices. We remain accountable for information processed on our behalf abroad. Appropriate purposes, meaningful consent and applicable safeguards still apply to development and advertising. Publicly accessible footage is not automatic permission for every use.
Provincial consumer rights, required refunds, statutory court access and applicable class proceeding rights remain available. Our general change of mind rule never limits a cancellation, cooling off or refund right that the law gives you where you live. In British Columbia, if you cancel a yearly plan after it renews, we refund the unused part within 15 days (Business Practices and Consumer Protection Act, s. 25.1). For App Store or Google Play purchases, we help you ask Apple or Google, and if they do not refund it within that time, we refund it to you directly.
4. United States
State privacy rights vary and often depend on statutory business, processing and exemption criteria. California's CCPA applies to covered businesses meeting its applicable revenue, data volume or sale/sharing revenue thresholds, including certain related entities. Where it applies, rights include knowing/accessing information, correction, deletion, opting out of sale or sharing, limiting specified sensitive information uses, using an authorized agent where permitted, and freedom from unlawful discrimination.
CCPA access, correction and deletion responses are normally due within 45 calendar days, with a permitted further 45 days on notice. Covered sale/sharing opt outs are honoured as soon as feasible and within 15 business days. Other states may provide portability, targeted advertising or significant profiling opt outs and an appeal of a rights decision. We provide the applicable appeal route with a denial.
We do not currently sell personal information or share it for advertising across unrelated services. If a covered activity is introduced, we provide the required notices and controls before it begins and honour recognized signals such as Global Privacy Control for their applicable scope. Service provider disclosure is assessed under its actual purpose and contract. Privacy complaints may be made to the California Privacy Protection Agency or your state attorney general.
Separate biometric laws can apply without general privacy law business thresholds. Where required, covered capture needs the specific notice, release, retention and destruction arrangements before collection. A general account checkbox does not replace them. Applicable restrictions on profiting from protected biometric identifiers continue.
Recurring charges require the disclosures and authorization required by federal and state law, with the applicable cancellation route and renewal notices. State consumer, subscription, injury and court rights remain available. These Terms do not create a nationwide waiver of them.
5. United Kingdom
Where UK GDPR applies, PadelCue is a controller for purposes it determines. A venue or other party can separately be a controller for its own activities. Our processing grounds, also used for the EEA where appropriate, are:
| Purpose | Ground where applicable |
|---|---|
| Requested accounts, purchases, Academy access and report delivery | Contract necessity for the person's requested service. Recording and sensitive uses additionally require their applicable permissions |
| Security, abuse prevention, proportionate diagnostics and lawful claims | Assessed legitimate interests, or a legal obligation where one applies |
| Tax, accounting and mandatory compliance records | Legal obligation |
| Optional identifiable development, promotional publication and consent based marketing | Specific consent for the identified purpose |
| Device storage or access | Required consent or an applicable narrow exemption, separately from the personal data processing ground |
We assess each affected person's position. A contract with a purchaser is not automatically a contract basis for every other player. Processing sensitive biometric identification also requires the applicable additional legal condition. You may request details of the ground and relevant interest for your information.
Rights include access, correction, erasure, restriction, portability, consent withdrawal, objection to legitimate interest processing and an unconditional objection to direct marketing, subject to the conditions of each right. Additional rights apply to qualifying automated decisions. We normally respond within one calendar month, with lawful extensions, verification or clarification arrangements where applicable. You may complain to the Information Commissioner's Office.
UK storage rules include limited statistical and appearance exceptions with conditions, information and an objection route. These do not create a general advertising exemption. Our Cookie Policy's optional opt in approach may provide a choice even where a narrower exception could legally apply. Restricted overseas transfers require an available lawful route, such as applicable adequacy or appropriate UK safeguards and assessment.
For qualifying distance purchases, a 14 day cancellation period generally applies. Starting digital content during that period requires express consent and acknowledgment of the resulting loss of the cancellation right, with the required confirmation. Starting an ongoing service is different: an express early start request may permit a proportionate charge, and the cancellation right is not lost merely because service begins. Loss on full service performance requires the applicable request and acknowledgment. A Bundle does not receive one automatic waiver for all components. The offer identifies any applicable exception, and required reimbursement follows the statutory period, normally within 14 days after cancellation notice.
Reasonable care and skill, promised features, required remedies and foreseeable consumer loss remain protected. We do not exclude death or personal injury caused by our negligence. You may use the courts available where you live in the UK. These Terms do not require a Toronto only claim.
6. Ireland and the EEA
Where EU GDPR applies, the controller explanation and purpose table above apply using the EU legal framework. Rights include access, correction, erasure, restriction, portability, consent withdrawal, objection to legitimate interest processing and direct marketing, and the protections for qualifying automated decisions. We normally respond within one month, with up to two additional months where legally justified and notified within the initial month.
You may complain to Ireland's Data Protection Commission or another competent EEA supervisory authority, including in the country of your habitual residence, work or alleged infringement. EEA transfers use an available adequacy decision or other valid transfer mechanism with the required safeguards. A Canadian address alone is not a universal transfer exemption.
In Ireland, analytics cookies, including first party analytics, require consent. Only an applicable narrow exception permits device storage or access without it. A UK statistical exception does not apply simply because an Irish visitor reads English.
Irish consumers retain statutory digital content and service conformity, remedy and withdrawal rights. Qualifying distance purchases generally have a 14 day withdrawal period. Immediate digital content and early start services require their distinct statutory choices and confirmations. Beginning a service does not automatically waive every withdrawal right. Required reimbursement is normally due within 14 days of withdrawal notice. Material digital changes remain subject to the statutory reasons, notice and available termination rights.
Irish consumers may use the Irish courts where the law provides, and their statutory protections against unfair terms continue. Required compensation and liability for death or injury are not removed by a general disclaimer. Consumer information is available from the Competition and Consumer Protection Commission. Other EEA countries may require further local terms and language information for an offer.
7. Australia
Where the Privacy Act and Australian Privacy Principles apply, you may request access and correction and complain about handling. We respond within a reasonable period, generally 30 days. This is not a claim that every organization has an identical statutory 30 day deadline. Sensitive information, secondary uses, retention and overseas disclosures remain subject to the applicable APP requirements. Contact us first about a privacy complaint. Unresolved matters can be raised with the Office of the Australian Information Commissioner.
The Australian Consumer Law provides guarantees and remedies that cannot be excluded. Depending on the failure, these include repair or supply again, cancellation/refund and compensation for reasonably foreseeable loss. Our exclusions and liability limits do not restrict these guarantees or remedies where they apply. Some business purchases also qualify for protection.
These Terms do not impose an automatic recreational services or injury waiver. Their statement about the inherent risks of sport does not limit a consumer guarantee or our liability for our own negligence. Any separately supported activity arrangement must meet the law that applies to it. You retain available Australian consumer courts and tribunals. The Australian Competition and Consumer Commission provides consumer guidance. State or territory consumer agencies can assist with individual disputes.
8. New Zealand
Where the Privacy Act applies, you may request access and correction and complain to the Office of the Privacy Commissioner. We normally communicate an access decision within 20 working days and provide approved information without undue delay. Any permitted extension is explained.
Relevant indirect collection requires notice under IPP 3A, including information received from another participant, club or provider, unless an actual exception applies. The Biometric Processing Privacy Code can cover automated identification, verification or categorisation using physical or behavioural characteristics. We apply its requirements where relevant, including necessity, proportionality, safeguards and notice. Overseas disclosures require an available lawful route and comparable safeguards where required.
The Consumer Guarantees Act and Fair Trading Act protections remain available. Our exclusions and business cap do not remove applicable guarantees, remedies or foreseeable loss compensation. These consumer Terms do not contract out of those rights or impose a pre dispute consumer arbitration requirement. You may use the courts or tribunals available under New Zealand law. Consumer Protection explains the guarantees.
9. Singapore
Where PDPA applies, you may request access, including applicable information about use and disclosure, correction, and withdrawal of consent on reasonable notice. We respond to access requests as soon as reasonably possible. If unable to provide the response within 30 days, we notify you within that period when to expect it. Correction follows the applicable requirements. We do not describe a general statutory portability right as already effective before its implementing rules take effect.
Purposes must be reasonable. Consent, deemed consent and statutory exceptions are assessed for the actual activity. Consent for model training requires sufficiently specific information. A vague product development label is not a blanket permission. Overseas transfers require comparable protection. Our Privacy Officer is the contact for data protection concerns. You may raise unresolved concerns with the Personal Data Protection Commission.
Applicable protection against unfair consumer practices and available civil remedies remain intact. Singapore's Competition and Consumer Commission explains those protections and the appropriate consumer assistance routes.
10. South Africa
Where POPIA applies, PadelCue is responsible for purposes it determines. You may seek access, correction or deletion of qualifying inaccurate, unlawful or no longer authorized records, object where the law permits, withdraw consent and complain to the Information Regulator. Access requests using applicable PAIA procedures normally require a decision within 30 days, subject to a permitted notified extension. Other requests follow their applicable periods.
Processing must satisfy its lawful grounds and purpose limits. Biometric or children's information can require additional authorization. Electronic direct marketing must meet its specific consent or limited existing customer rules. Foreign transfers require an available POPIA route and any necessary prior authorization. General account acceptance does not remove these requirements.
Applicable Consumer Protection Act and electronic transaction rights, including qualifying cancellation and remedy rights, prevail over the general Terms. You retain available local proceedings and complaint routes, including the National Consumer Commission.
11. India
India's Digital Personal Data Protection framework has phased commencement. As of this edition, core processing obligations and individual rights provisions scheduled for 18 months after the November 2025 notification's publication have not all taken effect. We apply provisions already in force and existing applicable law, including relevant sensitive personal data and security rules. This notice does not postpone rights already available to you.
Where current sensitive data rules apply, you may review and correct provided information, withdraw consent and raise a grievance under their conditions. Covered grievances must be addressed expeditiously and within one month. Contact our Privacy Officer for the applicable grievance route.
As the DPDP provisions become applicable, the relevant rights include access information, correction/completion/erasure, consent withdrawal, grievance redressal and nomination, subject to their conditions. Required notices, language choices, children's safeguards and government or sector specific transfer restrictions apply to affected services. A general English language clause does not override a required language option. Complaints to the Data Protection Board follow the applicable commencement and grievance procedure. Current official framework information is available from MeitY.
Applicable Indian consumer protections and access to competent consumer commissions or courts remain available. Contact us about a purchase or complaint without waiving those routes.
12. Gulf Cooperation Council countries
This section covers the United Arab Emirates, Saudi Arabia, Bahrain, Kuwait, Oman and Qatar. Availability depends on the service and location in your offer. Each country has its own rules. Our Canadian incorporation and these English terms do not replace applicable local law, required Arabic information or your right to use a competent local court or regulator.
Contact support@padelcue.com for personal data requests, purchases, cancellation and service concerns. Applicable rights, permitted exceptions and response periods depend on the law governing the request. We will explain any lawful refusal and available complaint route.
Sports recording, sharing and optional training must each have the permissions their actual use requires. A player’s consent does not replace a required authority permit. A venue’s legally required security cameras may operate separately. Refusing optional PadelCue sports recording does not instruct the venue to disable lawful security recording, or authorise us to use security footage for sports analysis.
13. United Arab Emirates
Where the federal Personal Data Protection Law applies, you have the rights it provides to information, access, correction, erasure, restriction, objection and review of relevant automated decisions, subject to its conditions. Processing must use consent or another basis the applicable law permits. Transfers abroad must satisfy the applicable transfer rules. The DIFC and ADGM have separate data protection regimes when their respective scope tests are met. Operating somewhere in the UAE does not automatically select either regime. Complaints may be addressed to the UAE Data Office through the relevant government route, the DIFC Commissioner of Data Protection or the ADGM Office of Data Protection, as applicable.
Where UAE consumer law governs the offer, required Arabic product or service information, contracts and invoices must be supplied, and mandatory service remedies remain available. Applicable restrictions on using consumer data for marketing cannot be waived by a general consent clause. These requirements depend on the actual seller and transaction, including the law’s scope for electronic commerce. You can contact the relevant economic department or the UAE consumer protection authorities.
14. Saudi Arabia
Where the Saudi Personal Data Protection Law applies, including covered processing abroad of residents’ data, you may request information, access, a readable copy, correction and destruction, subject to lawful exceptions. You may withdraw consent. Consent to processing unrelated to the service must not be a condition of receiving it. Any other processing basis must satisfy the Saudi rules, including restrictions on using legitimate interests for sensitive data. Transfers abroad require the applicable Saudi safeguards. Privacy complaints may be made to Saudi Arabia's national data protection regulator.
Where the Electronic Commerce Law applies, the qualifying seven day cancellation right for an unused service runs from the service contract, subject to the law’s conditions and exceptions. It is not an unconditional right to cancel any used digital product. Required remedies for delayed or defective performance and legally binding descriptions remain available. Contact the Ministry of Commerce about consumer complaints.
15. Bahrain
Where Bahrain’s Personal Data Protection Law applies, you may exercise its rights to information, access, correction, blocking or erasure and objections, including to direct marketing, subject to the relevant conditions. Processing and transfers abroad must have the authority required by that law. Certain processing, including surveillance recording and automated biometric identification, requires prior written authorisation. Consent alone does not replace that authorisation. A foreign controller falling within the law’s local equipment rule must appoint the required representative in Bahrain. Privacy complaints may be made to the Personal Data Protection Authority.
Mandatory consumer remedies and the accepted offer remain effective. The published fifteen day remedy for defective or nonconforming goods does not create a general cancellation period for every digital service. Consumer complaints may be made to the Ministry of Industry and Commerce.
16. Kuwait
Kuwait’s current CITRA Data Privacy Protection Regulation applies to covered service providers licensed by CITRA. Where that regulation governs processing for your service, its notice, permission, protection and applicable data request requirements must be met, including required Arabic and English information. This statement does not represent that every overseas application is a CITRA licensee. Other applicable privacy and recording laws still apply. Relevant communications and data complaints may be raised with CITRA.
Your mandatory consumer remedies remain available. A goods return period does not automatically establish or exclude a cancellation right for a subscription, lesson or match report. Consumer complaints may be made to the Ministry of Commerce and Industry.
17. Oman
Where Oman’s Personal Data Protection Law and Executive Regulations apply, processing must meet their consent and transparency requirements. You may exercise the applicable rights to access, correction, updating, transfer, withdrawal of consent and deletion, subject to lawful conditions. Processing specified sensitive data, including regulated biometric or health data, requires a Ministry permit. Sending sensitive data abroad also requires the relevant Cyber Defense Center approval. Other transfers remain subject to the applicable consent and safeguards rules. Privacy complaints may be made to the Ministry of Transport, Communications and Information Technology.
Where Oman’s consumer law applies, required Arabic proof of purchase and mandatory remedies for deficient services remain available, including the applicable correction, repeat performance or refund remedy. Contact the Consumer Protection Authority.
18. Qatar
Where Qatar’s Personal Data Privacy Protection Law applies, you may exercise the applicable information, access, correction, withdrawal and deletion rights, subject to its conditions. Processing data of a special nature, including children’s data and relevant health or physical condition data, requires permission from the competent authority. Overseas processing remains subject to the law’s protection requirements. Privacy complaints may be made to the National Cyber Security Agency. The Qatar Financial Centre has a separate data protection framework under its 2021 Regulations and Rules where their scope applies, with complaints handled by the QFC Data Protection Office.
Required Arabic service information, prices and invoices and mandatory service remedies remain available where Qatar consumer law applies. The Electronic Transactions and Commerce Law provides a conditional default three day cancellation rule for covered electronic contracts, subject to agreement, performance and use or benefit. It does not guarantee unconditional cancellation after a service has been fully provided. Consumer complaints may be made to the Ministry of Commerce and Industry.
